A question for First Amendment experts, inspired by the execution... |
|
As we all know, it is a federal crime to threaten to kill a President, or to call for a President's assassination.
Is it likewise a felony to urge that a President be put on trial for war crimes or "crimes against humanity" resulting in, say, the murder of civilians -- and, if he or she is found guilty of these charges by a lawful authority, to be executed for said crimes?
I'm just wondering where the line is drawn here.

2. A while back Mike Webb pointed out that Gonzalez had warned Chimpy |
|
that the death penalty at the Hague was a possibility for his actions and suggested some maneuver to avoid that outcome. Webb suggested that such a trial could be appropriate and justified. Of course, the Reich-wingers went into ultra-hissyfit mode and claimed he had threatened their high lord and emperor, and if I recall correctly, the Feds were called in. At any rate, the upshot was that calling for a trial or asserting that death penalty crimes have been committed is far different than saying "I'm gonna kill that MF ASAP."
