It does if that immunity is included in the terms of surrender... I think. I'm not a lawyer (yet).

3. The end of major combat operations = end of the "war"
hence Saddam was not a prisoner of "war" when he was captured.

That's one argument. I don't really want to defend the admin so I won't seek others but, as much as they like to pretend this is a real war, legally speaking, in most senses it is not.

You can still be executed after a trial, just not summarily executed on the spot.
