Did I just hear Alito voted with the Liberal judges on his first rueling?

I just heard something on the news about some kind of Death Penalty case and Alito split away from the Right wing judges and voted with everyone else.

Anyone have a link?

I am not getting my hopes up, but wouldent that be a slap in the face of the Religious Right and the Conservatives if Alito ended up being another David Suter? That would be too cool. Again, not getting my hopes up.

It would be the sweetest revenge if this came back to bite the neocons in the arse. Didn't that happen with one of Pappy Bush's nominees?

Of course, then they'll just pressure another justice into retiring.

10. I suspect it may be the only facet of catholicism that sunk in.
But, with this gang it's more likely they're playing nicey on something they don't care about so much, just so the media gets the storyline set now that Alito isn't the fearful extremist the Democrats claimed he was.

As far as the media goes, they are so insulated I'm sure they think the media is a joke. And when you look at how many of the cases they hear even get mentioned, I can't see a reason any of them would care about it.

Also Wednesday, Alito was given his assignment for handling emergency appeals: Arkansas, Iowa, Minnesota, Missouri, Nebraska, North Dakota and South Dakota.

"WASHINGTON - New Supreme Court Justice Samuel Alito split with the court's conservatives Wednesday night, refusing to let Missouri execute a death-row inmate contesting lethal injection.

Alito, handling his first case, sided with inmate Michael Taylor, who had won a stay from an appeals court earlier in the evening. Chief Justice John Roberts and Justices Antonin Scalia and Clarence Thomas supported lifting the stay, but Alito joined the remaining five members in turning down Missouri's last-minute request to allow a midnight execution."

He joined the other 5 on at least one, the one where Missouri wanted to expedite the execution, so that is actually something and I'm quite surprised.

could be a peace offering on his part though.

i wouldnt look to into it tho.
enjoy the ruling tho, definitely makes me a lil more at ease

we'll just hafta see what comes next

cause frankly, we dont know why he decided the way he did. mite be another reason than just saving someones life.

25. So far, Roberts is looking more like we thought..
Alito would be. But it's still VERY early. We both said the same thing: after a contentious confirmation, maybe he tried especially hard to be fair here.

Usually they list an opinion with these- I have found none. Maybe he requested or needed more time or maybe he needs more information in order to make a decision. From what I have read about this case, it is only a matter of time before they put him to death.
