READ THIS AGAIN, please, from Fitz' letter:
"we have learned that not all email of the Office of Vice President and the Executive Office of President for certain time periods in 2003 was preserved through the normal archiving process on the White House computer system."
The headlines call this a "hint".
That's not a hint. It says nothing about LOST. "We have learned" = we have EVIDENCE. They have every shred of it, probably from the receiving parties. Fitz has evidence that the crap Dick's office forked over contained deletions.
If I got a letter like that it would chill me to the bone. Seriously, I felt woozy reading it and I HATE DICK CHENEY.

Patrick Fitzgerald, as we've all read multiple times now, takes it personally when someone lies to him. One can imagine that he's not going to shade the truth in a letter to opposing counsel, especially when he mentions in that same letter that he is less than entranced with the fact that opposing counsel misrepresented things he's said.

Why would he make the statement if he doesn't have the evidence to back it up?

This is pressure. I'm assuming it's pressure to get someone (Cheney? Be still my heart) to start talking.
The text clearly states that he KNOWS "some" weren't archived, which means "some" were! Which makes this violation of archiving policy harder to explain, huh?

Nixon was in deep; but Cheney, Rumsfeld and others we could name, are at core criminal mass murderers. The Plame outing is just the tip of the ice berg.

Fitz has made it plainly clear that the wide net they tried to cast will not fly. The character defense would be risky at this point as Fitz basically admitted they have impeaching material on Libby. None of which is subject to discovery, according to Fitz. Whatever dirt he does have on Libby must be good as Fitz stated his team has not requested search warrants or intercepted any communications. In short, Libby is serious legal jeopordy. It's quite possible that the his legal team will advise him to seek a plea bargin.
Or Libby's team could fight point by point and drag this out for years and wait for a pardon. This option will be very expensive and I think the determining factor will be Libby's financial standing.

There have been no search warrants executed and no communications intercepted pursuant to title III at the direction of the prosecution team during the course of the investigation
"at the direction of the prosecution." It doesn't say anything about individuals involved in the case, or any other entity.
