***Father Loses Home and Business for Teaching His Children to Work
Edited on Thu Feb-02-06 05:30 PM by AGENDA21
In January of 2003 the Department of Labor And Industries (L&I) issued me $34,000. in fines for supposedly “employing” two of my boys (then 11 and 13), and primarily on my own property.

They defined “to employ” as to “engage, suffer, or permit to work” with work defined as “an activity in which one exerts strength or faculties to do or perform something.” The only exclusions are nonprofit, agriculture, paper carriers, door to door sales, and domestic labor in and around your private residence that does not benefit a family “enterprise.” Their penalties were:

$1000/day “to work during school hours,” even though we home-school.

$1000/day to work “without an order from a superior court judge.”

$1000/day “to work more than ten feet above the ground level.”

$1000/day “to work on a construction site” (our private property).

$1000/day “to work in the proximity of heavy equipment.”

$1000/day “to operate a bulldozer and backhoe.”

$1000/day to be a “helper on a public roadway.”

$1000/day for “no valid Minor Work Permit”

$1000/day for “no Parent/School Authorization” form signed.

3. This sounds like a good one for Snopes......
I'm betting it's bullshit. Any father that lets his children operate heavy machinery, work more than ten feet above ground etc. deserves to be reprimanded in some way. I'm not saying these massive fines are in order, but he shouldn't be putting his children in harm's way just to save himself from paying someone experienced to do the work.

In other words, these people want to revert back to the days of children in sweatshops, treating their children as chattel and slave labor. I'm sure they're christianazis, people wanting to revert back to biblical days when everyone was "smiting" and "begatting" and stuff. :eyes:

8. Here in Charleston county, we aren't even allowed to
have anyone under the age of 14 operate a powered lawn mower. (They can use the old push reel type but nothing with an engine.) Can't use a weed whacker, hedge clipper or other powered landscaping tools.

Stiff fines and charges of child abuse if you get caught 'letting' your kid mow the lawn.

18. Yep. My grandson was ecstatic when he was no longer
allowed to mow the lawn. (This took effect 4 or 5 years ago. He was either 12 or almost 12 when it happened) Then he found out that it meant that he couldn't mow other people's lawns to earn extra money either.

19. Nothing wrong with a push mower..
We used to fight over "the red one".. It was a beaut..smooth as silk and was easy to push.. The "green one" was like pushing a ragged chunk of concrete up a hill:)

9. DARK-SIDED
The little girl on the right is wearing SHOES!

Doty, in his article, never mentions just what he had the boys doing. That raises a scent that is not sweet to my nose.

10. a moving company would involve lots of heavy lifting
and the farm would involve big equipment.

The boys probably boasted to someone about their "jobs" and someone dropped a dime on Dad

12. He was investigated because of complaints by co-workers
Sounds like he should be glad they aren't trying to terminate his parental rights for child labor exploitation.

The dispute started in January 2003, when Doty's house-moving business was hired to move a block of houses to make room for Yakima Memorial Hospital's expansion. L&I received several phone calls — some from Doty's co-workers — who were alarmed at the work Zach and Stephen were doing for their dad.

The boys, 13 and 11 at the time, were riding on the peak of a house as it moved down the street, callers reported, pushing up low-hanging traffic lights. They were flagging traffic at construction sites, driving bulldozers and backhoes, and they seldom — if ever — wore protective gear. Fueling fears for the boys' safety, a backhoe flipped with Zach inside.

"My bottom line is that these children should have an opportunity to survive to adulthood," Paradis said. "I absolutely support in his contention that he was in the right to teach his children a work ethic, but I also really believe that there are jobs that aren't appropriate for some age groups."

***

State laws say no one under 18 is allowed to do the kind of work the boys were doing, and the rules explicitly prohibit children from working backhoes and bulldozers, flagging traffic and working on rooftops.

Keeping the kids isolated, the kids are working to support the family and dad tries to play the martyr. Very sad. I hope they take the kids from him and get his wife some counseling.

To escape child labor laws, Doty family moves to Idaho
PUBLISHED ON November 25, 2005
Yakima Herald-Republic (WA)

CATALDO, Idaho (AP) - A family that faces thousands of dollars in fines in Washington state because it refused to pay worker's compensation insurance and employed its young children in a house-moving business has moved to Idaho to take advantage of that state's more lenient child labor laws. "It's less oppressive," said Jude Doty, a 48-year-old house mover, of his decision to come to Cataldo, a tiny community along U.S. Interstate 90,...

Yakima Herald-Republic YAKIMA - A state official said he plans to seek a restraining order against City Council candidate Jude Doty after an encounter between the two Friday afternoon at the Yakima offices of the Department of Labor and Industries.

that's a violation of national child labor laws -- not just state laws. I hope the Wage & Hour Division and the Justice Department fry 'em.
