So if they catch OBL, would it stand up in any court of law, because they didn't have a warrant ? And they would have to let him go?

Other than bush's word it was OBL and bush's lying empty promise to show us a white paper on OBL's guilt which to this day no one has seen.

none of the evidence they get that is collected illegally can be used in court.
At some point somebody may have to decide how legal "the program" really is--there might be some trials someday (don't hold your breath--the prisoners are secret, too!) and they might want to use evidence collected there. They won't be able to, but they don't care--they don't even get lawyers, let alone trials, in general, so I'm sure President Cheney isn't losing any sleep over it....
