Daou Report
by Peter Daou

SCANDAL FATIGUE, CATNIP & THE 'ANGRY' LEFT: A few months ago, Steve Benen, Carpetbagger and DR guest-poster, wrote a fascinating blog entry that chronicled a series of Bush-related scandals .... all of which had occurred in the space of a week. In that regard, glance around this site today. You'll find an over-abundance of stories that undermine the credibility and integrity of our current administration and of the party in power. This coincides with a recent wave of references to the "angry" left, as though anger at the apathy of the media, the political establishment and much of the public in the face of this cavalcade of scandals is somehow in bad taste.

8. So Far, Fitzgerald has Confined Himself to
charges connected with lying. Conspiracy, leaking classified information, and blowing an undercover agent's identity are much harder charges to prove.

With clever lawyers and ambiguous statutes these cases can fall apart. Fitzgerald seems like the careful type who will not issue an indictment unless he is sure of a conviction. I hope he's building a case against Cheney, but it may need additional evidence and take awhile for it to happen.

10. I agree about the lying but he was put on this case to find out
who outed the covert agent. I hope he's building his case against the individual(s) who did this.

6. Dems maybe
holding back - waiting until we're closer to November - so they won't get Swift-Boated or Rathered? Silence is golden. If they don't come out strong eventually, I'll call them a bunch of whiny wimps. Watch the House and Senate on C-Span. It's the only way you can see how tough they can be. MSM will never give them a boost with accuarate reporting.

7. Good question ..
They attack our every move (mistake?) because they stick together, they're more expert at manipulating any blowback, and they control the media when it really counts.
We do none of those things well - and oftentimes not at all. It's pathetic. We have very few backbones.

If he authorized it, it might be perfectly legal what Scooter did -- thus the indictment on grand jury issues.

16. There is a resonable argument that it isn't illegal
Cheney is an executive officer -- one of two. There is no question that Bush could have ordered it with his constitutional powers. Whether Cheney could have ordered it depends on various executive orders -- most of which are probably secret.

Now, there is question on whether this would be an abuse of power (IMHO yes), and subject to impeachment (IMHO yes), but criminal jepardy is a different question.

Meaning more than one. Libby only had two Superiors. Bush and Cheney. The Congress won't touch this. The American public? Mostly not interested in this.

21. EXACTLY...As I have said in the past, these people could eat live kittens
on the national news and the senate, congress and
the rest of what's left of America would think it was the
latest episode of "Fear Factor" or what ever that stupid
show is called.
We are SO past the window of turn around.
The LEGISLATION to squelch dissent has been rubber stamped,
with the complicity of our representatives, without so
much as a whimper from the majority of Americans.

Many of us who live in DU land have failed to notice
that WE are a VERY SMALL minority of those who actually
even FAINTLY comprehend what has happened.
Sometimes I wonder how many here really "get it."

18. Cheney has no authority to leak classified information.
Only the President has any authority in the executive branch. Constitutionally, the vice president presides over the Senate and casts tie-breaking votes. Other than that he has no other Constitutional obligations or powers.

I think a lot of pundits are assuming that Cheney is untouchable simply because he's de facto president. But he wasn't elected president and doesn't have any right to disclose classified information, unless directed to do so by the president.

Also, the vice president can be indicted. You don't impeach a vice president. You indict him and try him for crimes committed.

27. Chaney has as much power
as Bush decides to delegate to him.

Bush can legally declassify the entire government if he feels like it, and can delegate that power to Chaney. In that respect, Chaney is no different than a cabinet secretary except he doesn't need confirmation.

A VP can be impeached -- and its the only way to remove him from office. A VP in prison, just like a federal judge in prison, still retains his office.

For a minute you had me thinking

had washed onto the shores of DU.
AS IF these fuckers don't know what time it is
and DO NOTHING to uphold the rule of law!
Why? Because they are getting filthy rich in their

Fuck em all.
We are on our own and any one who thinks
otherwise needs to listen to Eisenhower's speech
warning us of the military industrial CONGRESSIONAL complex.
It has all come true.
