What are our leaders saying about UAE?
I heard B Boxer on Schultz yesterday.

I have heard H Clinton has Co-Sponsered a bill in opposition.

What are our Labor leaders saying?

I would like for this to be a thread posting comments or links to comments that our leaders have made on the subject. There have been plenty of Debate threads, but I would really like to see just a gathering of official statements.

Dear Mr. President:

In support of the decision by your Administration to allow Dubai Ports World – a state owned company – to operate U.S. ports, you said that the United Arab Emirates is a country that “plays by the rules and has got a good track record.”

Mr. President, are you aware of the following facts:

Dubai was a key transfer point for shipments of nuclear components that were sold to Iran, Libya and North Korea by the Pakistani nuclear scientist A.Q. Khan.
Prior to 9/11, the United Arab Emirates was one of only three nations that recognized the Taliban government in Afghanistan.
Two of the 19 hijackers on 9/11 were UAE nationals.
The 9/11 hijackers received assistance in financing their activities from two facilitators in the UAE.
The UAE remains a financial center and money transfer hub for terrorists.
Given this record, the Administration’s decision to allow a state-owned UAE company to operate U.S. ports should be revisited.

1. Part of what makes this mess is that you've got real workin' Joes in on it
The union guys working the docks, they're hard core Americans, man. Even the ones that aren't! I know it's just coming from the propaganda machine, so I have to take it with several grains of salt, but I've seen teevee news footage of big tough New Jersey longshoremen saying "hell no!" and getting real flag-wavy patriotic about this. BushCo really did a great job of conditioning everybody, and I think these guys on the waterfront are going to be hard-pressed to be convinced otherwise. Except...

...where are they going to go? Dubai Ports is not just buying 6 ports, they are getting 21, according to articles released this morning. If you suddenly find yourself working for Dubai Port World and don't like it, which port are you going to move to looking for a new job? Hmm? This is not going to sit well with the people who will actually be running the working end of the ports.

4. Joe Mentum and I aren't on speaking terms
Chris Shay and Nancy Johnson are, uh...well, not exactly raging liberals. I'm honestly not sure what their positions are, but thanks for reminding me check. My guess is they'll play this for a little outrage pr, then vote whichever way Bush wanted in the end, if there is even room for any more votes. I mean, if it can be found that these crooks can get by on a technicality, the port deal is still a done deal. I think it is, anyway. But I think it will set up a major disruption if the dockworkers suddenly feel they are being forced to work for the people who brought down the World Trade Center!

Dear Secretary Chertoff and Secretary Snow:

We are writing to express our serious concerns regarding your review of the purchase of Peninsular and Oriental Steam Navigation Company by Dubai Ports World (DP World). As this transaction will result in the transfer of multiple terminal operations in major U.S. ports to a Dubai-government owned entity, it would seem to demand a more rigorous assessment, if not a full investigation. Even more significant is the historic use of the United Arab Emirates (UAE) as a base for terrorism financing and operations. Therefore, we ask that you provide a briefing to our Committee, as soon as possible, on the basis for the decision to allow this transaction to proceed.

As you know, Federal law requires that the President review the national security impact of foreign investments in the United States. The President has delegated this responsibility to the interagency Committee on Foreign Investment in the United States (CFIUS), headed by the Department of Treasury and including representatives of the Departments of Commerce, Defense, Homeland Security, Justice and State. Although any one of the member agencies may raise an objection to the acquisition, we understand that in the current case, no objection was raised. Additionally, the government can place conditions on the purchase. The briefing to our Committee should include the conditions that will be imposed upon DP World should the acquisition go forward. Please describe the Committee’s deliberations regarding the national security implications of this transaction.

While the United Arab Emirates (UAE) is a recognized partner in the war against terrorism, it is located in a highly sensitive region of the world for terrorist activity. Some of the 9/11 hijackers traveled to the United States from the UAE, where they were engaged in operational planning for the attacks. Much of the financing for the attacks was transferred through the UAE banking system.

It is critical to our national security that the government thoroughly review pending foreign investments in the United States. We believe that the Administration should be working more closely with Congress where acquisitions are of such a sensitive nature. In addition, we will be looking into the DHS role in the CFIUS process to ensure appropriate consideration of homeland security concerns.

Thank you for your response on this important matter.

“I believe that the Bush Administration’s decision to allow Dubai Ports World to assume management and control of some of the nation’s biggest ports raises a host of security concerns that have not been adequately addressed. I strongly support efforts in Congress to place a temporary hold on this transfer so that a further investigation can be conducted, and Congress can review these findings before any final decision is made.

“It is not enough for the Bush Administration to say ‘trust us.’ More than four years after the September 11th attacks, security at our nation’s seaports remains dramatically underfunded. The American people deserve to know that all necessary steps have been taken to protect homeland security before this deal is allowed to go forward.”

Dear Secretary Snow,

We are writing to express our concerns with the impending acquisition of Peninsular and Oriental Steamship Navigation Co. (P&O) by DP World, a company owned and controlled by the Government of Dubai, United Arab Emirates (UAE). This transaction will result in foreign government control of P&O Ports, North America (P&O subsidiary), the largest port operator on both the Eastern U.S. Coast and U.S. Gulf Coast. We are concerned that the Administration is not giving this case the appropriate level of scrutiny required by law and ask that you direct the Committee on Foreign Investment in the United States (CFIUS) to conduct a full 45-day investigation.

Federal law requires the President or his designee investigate the impact on national security of a foreign acquisition if the acquisition “could result in control of a person engaged in interstate commerce in the United States that could affect the national security of the United States.” (50 USC App. §2170). The President has delegated this investigative authority to CFIUS of which you are Chairman. We understand that CFIUS has chosen not to conduct a formal investigation.

The law further mandates one of several factors be considered in determining a threat to national security: “The control of domestic industries and commercial activity by foreign citizens as it affects the capability and capacity of the United States to meet the requirements of national security.” Our country’s maritime ports are critical to our national security, vital to our military capability, and essential to our economy. Some 95 percent of all goods imported to the U.S. arrive through our ports.

Most importantly, our ports are our most vulnerable targets for terrorist attack. Despite efforts to improve port security by the Administration, only one in 20 shipping containers entering the U.S. is physically inspected. A single terrorist incident could shut down our system of container transportation, affecting our entire economy, as well as facilities relied on by the Department of Defense as military load-out ports.

Dubai, which owns and controls the acquiring company in this case, has been named as a key transfer point for shipments of nuclear components that were shipped to Iran, North Korea, and Libya, which were sold by Pakistan’s nuclear scientist A.Q. Khan. In addition, the UAE was one of only 3 countries (including Pakistan and Saudi Arabia) that recognized the Taliban as the legitimate government of Afghanistan.

According to the Congressional Research Service, many U.S. officials believed that al Qaeda activists have spent time in the UAE. In fact, two of the 9/11 hijackers were UAE nationals (Fayez Banihammad and Marwan al-Shehhi), and the Federal Bureau of Investigation claimed the money used for the attacks was transferred to the 9/11 hijackers primarily through the UAE’s banking system. Furthermore, after the 9/11 attacks, your department complained of a lack of cooperation by the UAE and other Arab countries as the U.S. was trying to track down Osama bin Laden’s bank accounts.

In light of these considerations, we expect CFIUS, as the President’s designee, to undertake a complete and thorough investigation of this acquisition in accordance with Federal law. The National Commission on Terrorist Attacks Upon the United States (a.k.a., “the 9/11 Commission”) found that on September 11, 2001, the “most important failure was one of imagination.”

– U.S. Senator Dick Durbin (D-IL) today said that the deal approved by the Bush Administration to allow a Middle East company to run six U.S. ports must be halted until Congressional review and approval. Durbin issued the following statement:

“There is strong bipartisan support for immediate review of the deal approved by the Bush Administration to turn over the operations of six major U.S. ports to a company based in the Middle East.”

“Republicans and Democrats have expressed concern about the sale and are proposing legislative action. I support legislation to block this deal until Congress has had an opportunity to review it and to vote on it. It is not unreasonable for Congress to examine the security aspects and the long-term policy that allows for the sale of our ports to companies owned by foreign governments.”

“With all the focus on the Dubai issue in the past few days, it is important that we not overlook the real problems of securing our ports. Only six percent of the nine million containers arriving at U.S. ports are physically inspected each year and we are billions of dollars short in meeting critical port security needs.”

“Until the Administration is willing to work with Congress to fund, equip and hire the needed personnel to protect our ports from terrorists, it will not matter if a U.S. or a foreign company is in charge.”

San Francisco – U.S. Senator Dianne Feinstein (D-Calif.) today urged a moratorium on the Bush Administration’s authorization of an agreement in which Dubai Ports World, a company controlled by the United Arab Emirates government, would take over operations at six major U.S. ports. The following is a statement by Senator Feinstein:

“I will support legislation to place a moratorium on the Dubai Ports World agreement so that Congress can conduct a more comprehensive review. I am especially concerned by the secrecy in which the Committee on Foreign Investment in the United States conducted its analysis. We do not know what issues were considered by this committee nor whether our national security interests were well served by the decision to allow the deal to go ahead.

Much more needs to be done by the United States to help secure our seaports. Each year, approximately 13 million shipping containers enter U.S. ports, including six million from overseas. Despite this high volume of cargo, only five percent of the containers are inspected.

As part of this effort, I have been working with colleagues on both sides of the aisle to pass legislation making our ports safer. The resulting legislation, the ‘Reducing Crime At America’s Seaports Act of 2005,’ was unanimously approved by the Judiciary Committee last year.

A compromise version of the bill is now included in the USA-Patriot Act reauthorization conference report, which will likely be passed into law next week. What this legislation does is to bolster the criminal laws governing our nation’s ports, bringing them in line with the realities of the threats posed by terrorists and others seeking to do our nation harm.

ut let there be no doubt: much more needs to be done. This includes increasing inspections of containers, improving intelligence, providing federal funding based on risk, and bolstering the physical security of our ports.”

Sale of U.S. Ports

In the wake of September 11, Senator Nelson believes that additional scrutiny is needed before allowing Dubai Ports World, a United Arab Emirates-owned company, to operate six U.S. ports, including the Port of Miami.

The recent news of the sale also has led Sen. Nelson to re-examine the nomination of David Sanborn to head the U.S. Maritime Administration, a man who previously held a top post with Dubai Ports World. The plan to sell the ports to this company was not made public until after a hearing on Sanborn in early February. Nelson is now planning to block the nomination unless Sanborn returns to the Senate Commerce Committee for additional questioning regarding this possible conflict of interest.

Congress should have an opportunity to weigh the facts and hear from the Administration as to why they do not view this as a security threat. I look forward to Senate discussion, hearings, and to hearing from the Department of Homeland Security and other relevant federal agencies on this issue."

Your editorial "Port hysteria" (Feb. 22) completely misses the mark. First, you say that foreign firms that run operations at U.S. ports are "not in charge of security." But the reality is far more complex.

Many of these firms have received federal port security grants from the Department of Homeland Security. Giving a country such as the United Arab Emirates a role in running our ports could make the job of law enforcement harder. Two of the 19 hijackers on 9/11 were United Arab Emirates nationals. Dubai was a key transfer point for shipments of nuclear components that were sold to Iran, Libya and North Korea by the Pakistani nuclear scientist Abdul Qadeer Khan. The United Arab Emirates remains a key financial center for terrorists.

Finally, your claim that lawmakers are ignoring port security is another fallacy. Since 9/11, Democrats in Congress have voted more than a dozen times to increase funding for port security.
