http://www.dallasnews.com/sharedcontent/dws/dn/education/stories/DN-smubush_23met.ART.North.Edition2.188dcf75.htmlThe Dallas lawyer who's suing SMU – contending that officials engaged in fraud and intimidation to oust residents of a condominium complex to make room for the library – has subpoenaed plans from the four finalists vying for the project: Baylor University, Southern Methodist University, the University of Dallas and a West Texas coalition led by Texas Tech University.
In the subpoena SMU received Wednesday,
Mr. Vodicka asked for multiple documents, including all correspondence between the individual finalists and President Bush, first lady Laura Bush and White House staff since Nov. 4, 2000. He also requested library construction plans, plus all documents related to SMU's master plan, centennial plan or strategic plan since Nov. 4, 2000.
Representatives for all four schools say they've received the subpoenas. The requests have left the schools scrambling to figure how to respond and what information to release.

The universities can try, as Texas Tech did, to work out an agreement with Mr. Vodicka. If that doesn't work out, the universities could approach the judge presiding in the University Gardens case. They could argue, for instance, to have the subpoena thrown out. Or they might be willing to produce their library proposals but want them sealed so they're not part of the public court record.
