BREAKING: Sup. Court Allows Transfer of Padilla to Civ. Court

WASHINGTON - The Supreme Court agreed Wednesday to let the military transfer accused "enemy combatant" Jose Padilla to Miami to face criminal charges in at least a temporary victory for the Bush administration.

The justices overruled a lower court, which had attempted to block the transfer as part of a rebuke to the White House.

The high court said it would decide later whether to review Padilla's challenge to his military detention. It granted the Bush administration's request for a transfer in a one-page order.

Padilla's jailing as an enemy combatant for the past 3 1/2 years has been the subject of multiple court rulings and criticism by civil rights groups.

4. Actually, it is.
We've been trying to get people out of the military tribunals for years. Now that this one is out, it can go through the regular process. Supreme's can still review tribunals, of course, but perhaps not as quickly as it would if Padilla had not been transferred. Bush was not left with any good options here, in my view. So, I don't see how this is a bad thing for us.

5. Actually it isn't.
They are refusing to make a judgment call on whether holding detainees this long is illegal. Not good at all.

8. He is not out from under the tribunals - after this case is tried, win or
lose, he goes back as an enemy combatant to continued military detention.

10. The reason the transfer was rejected by the lower court was this game
of hiding him in a criminal trial until Alito can get on the USSC and rules he is never freed because war of terror never ends.
