14. Very interesting.
Two things stand out immediately. First, the mention of the Bush-Cheney connection is mentioned as showing Libby's role was part of something larger; second, the defense will likely call Rove.

16. I've gone through the reply
and am now looking at the exhibits. I'll have some impressions soon. But right now, it is obvious that: {a} Team Libby is looking to focus attention on everyone involved, outside of the OVP; and {b} he is probably getting closer to revisiting the previous attempts to make a deal with Fitzgerald. He had been prepared to before 10-05, but was not willing to accept the long incarceration. But it seems likely that his legal team -- al extremely talented legal minds -- realize that he faces certain conviction if this goes to trial, and the door is closing on issues for appeal.

Libby Says Bush, Cheney Didn't Authorize CIA Agent's Name Leak

“April 13 (Bloomberg) -- A former top administration official said President George W. Bush and Vice President Dick Cheney authorized him to discuss with reporters intelligence on Iraq's weapons program and didn't authorize leaking a CIA agent's name.

Former Cheney chief of staff I. Lewis ``Scooter'' Libby, in documents filed late last night in the U.S. District Court for the District of Columbia, said Bush and Cheney only authorized him to disclose once-classified details from a National Intelligence Estimate paper that they believed supported the president's claims that Iraq was attempting to buy nuclear material in Niger.

Libby has been indicted on charges of perjury, obstruction of justice and lying to FBI investigators about whether anyone in the administration revealed the identity of former CIA agent Valerie Plame Wilson. Prosecutor Patrick Fitzgerald, in an April 5 court filing, tied Bush for the first time to an attempt to counter critics of the March 2003 U.S. invasion of Iraq, suggesting he used Libby to funnel information to reporters.

Any argument by the government that the case involves only Libby and Cheney's office ``is a fairy tale,'' said the 26-page document filed by Libby's lawyers. ``Mr. Libby's actions were authorized at the highest levels of the executive branch.''cont…

Libby Team Says He Was Not Ordered to Leak Plame Name

NEW YORK A court filing by special prosecutor Patrick J. Fitzgerald released last week suggested that former White House aide Lewis "Scooter" Libby had been instructed by his boss, Vice President Cheney, to leak parts of a classified or formerly classified document to reporters in 2003.

But a new filing from Libby's attorneys yesterday revealed that in grand jury testimony two years ago, Libby did not assert that Cheney or President Bush ordered him to disclose the name of CIA officer Valerie Plame.

As summarized by The Washington Post on Thursday, in their filing the Libby lawyers "asserted that White House documents outlining what Libby was to say in conversations with reporters did not mention Plame's name. They said this supports Libby's contention that he did not participate in a campaign to damage Wilson by disclosing Plame's CIA employment or in a coverup of the episode."

Exactly what these "White House documents" are may now become a key part of the case.

The indictment puts directly at issue Mr. Wilson's trip to Niger and subsequent comment and analysis concerning the trip, including discussions about Mr. Wilson's wife and her role in selecting him for the trip.

Selecting? Sorry, but the red herring that Mrs. Wilson selected him was disproven long long ago. Looks like the Fibby defense is all set up to rehash old canards. Still does nothing to disprove that Libby lied, perjured, and obstructed justice!

32. Page 24 of the Fibby Response has an interesting statement.
For example, if documents indicate that notwithstanding the President's public statements about the leak investigation, Mr. Libby had no reason to fear losing his job, the defense is entitled to the production of such documents.

So, the defense believes there is a document from Bush (or Cheney) that would have kept certain targets, uh excuse me, officials employed even if they were involved in the leak?

Is this just hot air? Or might this be about a document pertaining to specific officials? Like, say, one with the last name Rove?

I tend to interperate this reference as probably specifically Bush-oriented

It was Bush himself who made an on-the-record statement that he (not Cheney, not anyone else) would fire anyone in his administration found out to be the administraton leaker.
