Question for Lampson followers/Texans |
|
Does anyone know -- if the election is not held until the day of the general election, is it still a special election? I'm talking technically, as this is for a copy edit of a newspaper story. Thanks

http://www.chron.com/disp/story.mpl/metropolitan/3774754.htmlAUSTIN - Gov. Rick Perry said today that he will not call an election to fill the congressional seat to be vacated by U.S. Rep. Tom DeLay before November if DeLay doesn't resign by Friday.
"The legal issue of when does that seat become vacant is when I get that (resignation) letter, and as far as I know I don't have a letter,'' Perry said.
"If I don't get it by close of business tomorrow, the election will be in November.''
DeLay has said he intends to resign in June, but former U.S. Rep. Nick Lampson of Beaumont, the Democratic nominee who hopes to succeed him, has been urging DeLay to quit earlier so that a special election can be held on May 13, the next uniform election day before November.

What will happen is that Delay has delayed enough that there will not be a special election and it sounds like the Rs will pick who will be on the ballot on the fall in the general, although I am still not sure if that exactly IS legal based on our discussions of it in the Texas forum.
