The US Supreme Court has declined to hear a case brought by Jerry Falwell against a New York man who registered a similiar-sounding domain name which he used to criticize Falwell's stance on homosexuality. Christopher Lamparello started fallwell.com to show people why "Rev. Falwell is completely wrong about people who are gay or lesbian."
The site got Falwell's attention; he sued for ownership of the domain several years ago, claiming that it was a confusing use of his name. He won the initial case, but Lamparello appealed to the Fourth Circuit Court of Appeals, which overturned the initial decision in 2005. Falwell's lawyers then decided to go all the way to the Supreme Court. They asked the justices to take the case, but word came down on Monday that the Court had declined to hear the appeal. Lamparello could keep his site.
