OSHA sets deadline for company's appeal in worker's death ($16,800)

KENOSHA, Wis. (AP) - A Racine company has one week to appeal federal citations resulting from a worker's death in a trench collapse in Somers.

Fifty-2-year-old Juan Oviedo survived the initial collapse on Dec. 19 but suffocated as others tried to rescue him. He had been helping install sewer lines for a planned Wal-Mart Supercenter.

The federal Occupational Safety and Health Administration citations for safety violations total $16,800.

OSHA area director George Yoksas says the agency met with representatives from A.W. Oakes & Son on Tuesday. He says the company has until April 30 to contest the violations, enter an informal settlement agreement with OSHA or reach some other resolution.

Yoksas says if the company does not act by then, the citations will become final.
