Civil rights supporters in the Senate didn't surrender to the segregationists when they filibustered for 57 days against the Civil Rights Act of 1964.

is probably being used as a bargaining chip in the stimulus negotiations. I think it will be held back until next Spring. If the Repubs filibuster it then, the labor movement will be energized for the mid-terms. IMHO.
