City settles with its attorneys

The City Commission approved three agreements Monday that essentially allow Deputy City Attorney Jim Marcinkowski and Assistant City Attorney Brian James to retire with benefits.

The city began taking away the work duties of the two municipal attorneys after City Attorney Chuck Semchena retired in fall 2005 to the point where they did almost nothing to earn their paychecks.

Marcinkowski was paid about $97,600 and James $89,000 a year.

The pair, along with confidential secretary Carol Schwanger, made up Teamsters Local 214, which was disbanded Monday.

All commission votes were 5-0 because Mayor James Ellison left after a closed session to attend the birth of a grandchild and City Commissioner Stephen Miller was ill.

City Attorney David Gillam said both Ellison and Miller were in favor of the separation agreement that lets Marcinkowski retire and a resolution that gives James a duty-disability retirement.
