A federal district judge Wednesday delayed the effective date of new rules that would make it easier for airline and railroad unions to win representation elections.

U.S. District Judge Paul Friedman of the District of Columbia signed an order that said the new rule won't go into effect until June 30.

In the meantime, he'll hold a June 14 hearing on a motion by the Air Transport Association for a preliminary injunction that would hold off the new rule's implementation until the court could decide on ATA's challenge.

"We are pleased that the effective date of the new rule has been delayed," ATA spokesman David Castelveter said. "This gives the courts a more reasonable time frame to hear arguments and render a decision on our motion for a preliminary injunction."

The National Mediation Board recently adopted the new rules that revised the way that it would count votes in a representation election.

The current rules say that to win the right to represent a group of employees, a union has to get an "aye" vote from more than 50 percent of the workers eligible to vote. Those who don't vote are in effect counted as "no" votes.

1. Let's have an election for this judge on whether he keeps his job.

Count all the ayes and nos with all those not voting counted as nos. I bet he get voted out of office real easy.

Even elections for unions outside the airlines and railroads unions only count the votes that are cast.

I'm wondering if the companies involved with this type of election do everything they can to arrange for the elections to be held at the most inconvenient time and place possible?


As for those voting no if they don't put forth the effort than that can only mean they don't care one way or another if they are not impeded from voting. If there vote is going to count it should be 1/2 no and 1/2 yes at best.
