In February 2003, a Florida Court of Appeals unanimously agreed with an assertion by FOX News that there is no rule against distorting or falsifying the news in the United States.

Back in December of 1996, Jane Akre and her husband, Steve Wilson, were hired by FOX as a part of the Fox “Investigators” team at WTVT in Tampa Bay, Florida. In 1997 the team began work on a story about bovine growth hormone (BGH), a controversial substance manufactured by Monsanto Corporation. The couple produced a four-part series revealing that there were many health risks related to BGH and that Florida supermarket chains did little to avoid selling milk from cows treated with the hormone, despite assuring customers otherwise.

According to Akre and Wilson, the station was initially very excited about the series. But within a week, Fox executives and their attorneys wanted the reporters to use statements from Monsanto representatives that the reporters knew were false and to make other revisions to the story that were in direct conflict with the facts. Fox editors then tried to force Akre and Wilson to continue to produce the distorted story. When they refused and threatened to report Fox’s actions to the FCC, they were both fired.(Project Censored #12 1997)

Akre and Wilson sued the Fox station and on August 18, 2000, a Florida jury unanimously decided that Akre was wrongfully fired by Fox Television when she refused to broadcast (in the jury’s words) “a false, distorted or slanted story” about the widespread use of BGH in dairy cows. They further maintained that she deserved protection under Florida’s whistle blower law. Akre was awarded a $425,000 settlement. Inexplicably, however, the court decided that Steve Wilson, her partner in the case, was ruled not wronged by the same actions taken by FOX.

FOX appealed the case, and on February 14, 2003 the Florida Second District Court of Appeals unanimously overturned the settlement awarded to Akre. The Court held that Akre’s threat to report the station’s actions to the FCC did not deserve protection under Florida’s whistle blower statute, because Florida’s whistle blower law states that an employer must violate an adopted “law, rule, or regulation.” In a stunningly narrow interpretation of FCC rules, the Florida Appeals court claimed that the FCC policy against falsification of the news does not rise to the level of a “law, rule, or regulation,” it was simply a “policy.” Therefore, it is up to the station whether or not it wants to report honestly.

During their appeal, FOX asserted that there are no written rules against distorting news in the media. They argued that, under the First Amendment, broadcasters have the right to lie or deliberately distort news reports on public airwaves. Fox attorneys did not dispute Akre’s claim that they pressured her to broadcast a false story, they simply maintained that it was their right to do so. After the appeal verdict WTVT general manager Bob Linger commented, “It’s vindication for WTVT, and we’re very pleased… It’s the case we’ve been making for two years. She never had a legal claim.”

Maybe another amendment that fits with modern times?

FOX asserted that there are no written rules against distorting news in the media. They argued that, under the First Amendment, broadcasters have the right to lie or deliberately distort news reports on public airwaves.

Faux news argued IN COURT for their "right to lie and deliberately distort" (http://en.wikipedia.org/wiki/Misinformation">disinform). Surely, that in and of itself is evidence of what their modus operandi is!

would do some investigating on FOX news. If they lie about what they broadcast, maybe they lie about what they report on their paying of taxes. It be nice to see Rupert Murdock sent to prison, or at least sent back to Australia.

Since when does an Australian have the ability to run rough-shod over American air-waves? If the air-waves are truly owned by the American people, why is a foreign entity allowed to foment sedition, riotous behavior and anti-American rhetoric. If Murdock had ties to people like Saddam, or Bin Laud en (who's to say they don't?) Fox would have been dismantled for the terrorist organization it actually is. Bad enough that he pals around with known war criminals, like John Madden did Sunday night...

We as a country survived the period with news barons called "Yellow Journalism" and the basic difference is instead of print media, this is TV and radio. It is the same situation that there are a few powerful interests, this time multi-national conglomerates, forcing their view as the gospel. The point is they are multi-national so their interests are not completely American, like Faux.

Once the FCC grows a pair, and that goes for Congress as well, and we start Trust-Busting like Teddy Roosevelt did, then we can begin to reign in these anti-Americans. When this happens, I want to be there to help pull the plug on the biggest air-waves polluter, Faux.

Faux News advertises itself as "Fair and Balanced," and as we all know, they even tried to sue Al Franken because they believed they trademarked that term. If it can be proven in a court of law that they are not, then Faux would be in real trouble. Plus they'd be humiliated, and that would simply be schweet!

16. I personally witnessed CNN doing far more crowd organization during the Elian debacle in Miami.
Telling them where to stand, where to set up their own barricades, and when to cheer or hoot.

All MSM do it at some events.

21. Thankful for Journalists Like Rick Sanchez
I guess you have to be thankful for journalists like Rick Sanchez who are still interested in getting to the truth behind matters. This country would be in much better off if there were more journalists like Rick Sanchez. It seems to me that there are a number of journalists who are not interested in putting out real information, but are just interested in putting stuff out there.

For years the rest of the media has been trying to be more like Faux, which has been a big source of the problem. Everybody tries to copy the leader. But maybe now they realize that Faux already has a lock on the paranoid, racist nutjob vote. They and all the other news outlets would do better to try and attract a different demographic.
