Interview on FoxNeus Sunday in which Supreme Court Justice Breyer gives some interesting insight into his views on gun control in regards to Washington DC ruling, the Supreme Court's appearance at the State of the Union, 'I'll be there' - and some brushstroke comments on how the court functions behind the scenes 'I've never heard a raised voice during our discussions - not ever'. The subject of the Health Care mandate also is brought up.

His comments are riling the Conservatives who think they are the only ones who have a crystal ball on what the writers of the Constitution were intending. Good to watch, even if the posting comes from the 'other side'.

Not sure how long the video will be up btw...

I never heard him before. He is smart, personable, articulate. I'd go to hear him talk.

3. What a great interview. Justice Breyer was absolutely wonderful.
And even Chris Wallace, much as I hate his guts, wasn't too bad at all in this case.

But the Justice was totally remarkable in my view.

5. Wallace is such a self righteous ass
He thinks he's brilliant. Notice his hand gestures and pointing. He thinks he's nailed the guy. Breyer proceeds to patiently dismantle his once sided attack.

7. Nice respectful of the nutcases now on the court. "Dred Scott" may be in the book but Wallace HAD
to mention it.

Dred Scott is the weirdest of catchpharases in our recent history. It has nothing to do with abortion and it has less than nothing to do with anything in modern life but the rightwing runs it out to string out a one-issue crowd.

Breyer was very respectful and Wallace made no headway with him whatsoever, as you've all said. Very enjoyable to watch. Thanks for posting, as I would never have seen it otherwise.

10. Justice Breyer should have mentioned the Federalist Papers when discussing "intent".
I think he did a wonderful job of dealing with that asswipe, but waving his well-worn copy of the Constitution could have been bolstered by bringing in some other references.

12. Justice Breyer did well with the FOX
interview format toward liberal guests because, being who he is the usual FOX M.O of interrupting such guests, getting loud and offensive with them and letting the interviewer do most of the talking was not employed.

I disagree with his stance on the second amendment, but other than that I like the cut of his jib.

Breyer seemed to dismiss the second amendment as something Madison constructed to pacify other states into making sure they would want to ratify the Constitution.

Well, if that is what those other states wanted, then that is what they wanted!

He further seemed to latch onto the initial clause that speaks to militias, without mentioning that the state militias, which the Constitution says are necessary to the security of a free state, were taken over by the federal government about a hundred years ago.

15. The 2nd Amendment
Anyone interested in what Breyer was talking about when he discussed the 2nd Amendment should consult Federalist Paper #29, where it is CLEARLY stated that "well-regulated" means "trained like an army". There is even a bit of implication there that untrained gun ownership is dangerous. Nothing in the Constitution allows wholesale gun ownership. This idea is also reinforced by the way Breyer insists on looking at the values and understandings in place in the late 18th century.

I could care less if somebody owns one gun or a million guns. Just don't try to use the 2nd Amendment to justify it.

16. I've ALWAYS liked Breyer, but I am not 100% objective
On New Year's day, 2005, I was asked to give a speech called "if these were my last words." I talked about
the fact that I had almost died in late April of the previous year, and that I rejected all the religious arguments
that I was offered about how God/Allah/The Great Spirit/The Great Pumpkin etc. etc. had decided that it wasn't
"my time" yet.

I ran into Breyer, who was in attendance, after I was done, and he smiled and told me, "good speech!"

I had always admired him before that, but after that, he always held a special place in my esteem.

By the way, the first time I met him was in the mid 1990s, right after he had been appointed to the
Court by Bill Clinton. He stuck out his hand and said, "Steve Breyer." Not "Justice Breyer," just Steve.
He is one of the most intelligent people I have ever met, but totally has his feet on the ground, humbled
by his job, not at all stuck up like Roberts or Alito. Breyer is one incredibly wonderful human. If we had
eight more like him on the Court, our country would be a FAR better place than it is now. Actually, I'd settle
for four more like him!
