Senator Al Frabken (D-MN) speaks at the second Netroots Nation MN Conference. In his lunchtime speech, he talks about the necessity of net neutrality and the dangers of the NBC-Comcast merger. Speaking on the weak FCC rules supporting Net Neutrality, Franken said that "This is the first time that the FCC has allowed discrimination on the internet." Franken calls the fight for net neutrality, the First Amendment fight of this generation. Watch his full speech, as well as his responses to some questions from the audience, here.

1. Franken got it wrong

The discrimination has always been there at low levels and the FCC never did a thing about. They even said they could not. The difference is that the bandwidth providers are now in the application and other services business and want to control which applications get primary service.

Its not clear the FCC has the authority to enforce what the passed recently without some additional legal foundation. If the new rules get tossed out by the courts, what will Congress do?
