4. this will come down to 2 major court cases,(1)is the healthcare reform constitutional(2)interpreting |
|
the supremacy clause in the 6th Article of the US Constitution which states :
"This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding." --------------------------------------------------------------------------------------------------------
The key argument that the 10th Amendment people will use is the phrase in Article 6 which states " which shall be made in Pursuance thereof". They argue that because healthcare is not enumerated in the Constitution, that this law is NOT "made in Pursuance thereof", and therefore the supremacy clause is not applicable.
Of course, if just the healthcare itself is found unconstitutional, then the nullification argument gets put to bed (in terms of flash-points) for awhile.
It will be interesting......

...Michigan. Due to the future security problems cause by the Texas Army's poor performance against invading drug cartels. Because you know it just gonna turn into a Christo-Facist Rethug state and not a Libertarian utopia, if they secede.
