Human Rights First Senior Associate Daphne Eviatar weighs in on President Obama's April 4 decision to try alleged 9/11 mastermind Khalid Sheikh Mohammed at Guantanamo Bay instead of New York City. Obama previously announced that he was aiming to close Gitmo, but two years later could he actually have done it? With critics from all sides questioning Obama's handling of the current economic crisis, to what degree will this trial really impact the American public?

1. So Daphne Eviatar really believes the indictment ?
The main accusations detailed in the indictment are found on p. 13-33, in the "overt actions" section under the banner first count covering the global al Qaeda terror conspiracy. The main stuff against KSM pops up on p.13-14, alleging that he proposed the plot using planes and trained the hijackers on how to use and conceal knives. It also says he showed them how to obtain drivers licenses in the U.S., where he had lived and attended college in the 1980's. None of these allegations are new -- not even the detail that KSM's knife training of the 9/11 hijackers included stabbing sheep and camels.

3. I'd feel a lot better if...
it weren't for a few nagging "details" in the story of KSM's confession. He confessed to many things, all of them after his torture sessions. A few pieces we can put together from news stories don't make me comfortable at all.

1. CIA holds young sons of captured al-Qa'eda chief

2. We have your sons: CIA

3. Yoo says President has right to "crush the testicles of a suspects child" to get them to talk.

4. Seymour Hersh: Children raped on camera in front of women at Abu Ghraib. How bad are these photos?

Now throw in the "secret evidence" reality of military tribunals and I get real uncomfortable about what the actual truth might just be. And skeptical that anybody will ever be allowed to find out just what really DID happen.
