In my American History class I'm in now, they said the constitution limits the court to 12 justices. It has only been nine for decades because of a agreement to keep it so. In other words if we get a democratic president and congress, we could possibly turn the court around quickly.

The Constitution does not specify the number of justices on the Supreme Court. When first constituted, there were five. Prior to the Civil War, the number was ten. Congress, during its snit with Andrew Johnson, abolished a seat rather than let President Johnson appoint a new member. FDR's court packing scheme in the thirties would have resulted in 16 justices sitting on the Court.

the more the better for keeping things from tilting too far one way or another, but for now, an extra 4 would be great to swing things back to where they should be. then maybe Congress could establish 16 is the mandated amount, if that makes sense, sorry if it doesn't.
