NPR..Legal Discussion of quarantened TB Carrier/ Involves Habeus Corpus ( (Detained with Fed Guard) |

Fascinating discussion about how this man is in a hospital with a Federal Guard outside his door and the Legal Questions it raises. Apparently the Law to Detain him and have him quarentened hasn't been used in 40 YEARS! A lawyer for health policy was on saying that he has a right to Habeus Corpus...and since the law hasn't been used in might need some "updating."
There are alot of issues with this Man's Plight. Jurisdictional Issues, Privacy Issues and how much of a threat he really posed to the population at large.
(I can't help but think this is another Bush Grab for power....an excuse to do away with Habeus if you are considered a "health threat." Testing the waters)
I hope the guy sues and wins...At least his case will give some attention to Habeus rights.
BTW the man didn't want to be held in a foreign country (because he's an American) and so he and his fiance took those measures so he could get back to the states for treatment. Seems logical to me not to want to be stuck in a foreign country. But, whether that was the correct thing to do or not...being in a hospital room with a Federal Guard out side the door might seem extreme to some, also.

why he decided to fly anyway, knowing he was sick and the docs didn't want him to. That's just stupid.
Having said that, the HC and guards outside his door is incredibly creepy.

I'm sure he didn't want to change his travel plans and decided to slip out of the country while the going was good. Bad move--if he had stayed here, he wouldn't be in this mess. He must have balls of steel to think he could get away with this--one last "good time" before his 18-month treatment began--of course, he did get away with it, and now look what's happened.
I'm sorry if that offends anyone, but I've worked in the medical field for too many years to not know that this was a STUPID move by this guy. I'm sure the medical authorities felt they had stated their concerns strongly enough to make him understand that he was in a dire situation, but some people just won't listen.
I don't feel badly for him at all--even a small outbreak of this strain would be a national emergency, that's for sure.
I wonder how the people objecting to this quarantine would feel if he had been infected with the Ebola virus . . . .

Also we do not know some details, such as... has he been treated before
Did he take his meds as ORDERED
The last time these laws were applied in a more general manner were during the Influenza of 1917
If we have bird flu you will see this too
What scares me, is that somebody like Bush will not let the emergency go... in fact, I smell he's praying for a break up

there would be fewer questions asked about his situation. Which would likely be far worse than it is now.
This asshole was told to stay home because of his disease, but he decided to up and fly to Greece and infect the Mediterranean, to say nothing of his new wife and the wedding party. Then, when he gets held up in Rome, he juimps on a plane again.
And yet, he has "rights."
So, we have here a highly publicized known carrier of a dread disease while there are how many of minimal threat being flown around between the Gitmos we set up around the world?
desCartes was right-- God is a comedian with an audience afraid to laugh. A pretty game practical joker, too.

Americans have so pitifully little concept of the ramifications of epidemiology that they just don't get the importance of health authorities being able to do this.
It may be you or your child that is saved by swift public health actions some day - consider THAT.
