Couple Sue Wal-Mart Over Slip In Vomit

DAVENPORT, Iowa, May. 30, 2007
--------------------------------------------------------------------------------
(AP) A woman's fall in a puddle of vomit has resulted in a lawsuit against Wal-Mart. June Medema, slipped in the vomit at a Davenport Wal-Mart on June 13, 2005, according to the lawsuit, filed by Medema and her husband, James, in Scott County District Court earlier this month.

Medema claims that she was seriously injured in the fall.

The lawsuit alleges that Wal-Mart's negligence led to Medema's fall, but it does not specifically say how the store was negligent.

John Simley, a Wal-Mart spokesman, decline comment saying he hadn't seen the lawsuit.

The lawsuit claims that Medema suffered serious neck and upper back injuries in the fall and has undergone several surgeries and is unable to work.

1. Probably just being IN Wal-Mart made somebody else vomit, and this woman slipped in it.
Eww.

And I can't help thinking about how a former Spinal Tap drummer died...

3. Every store has insurance to cover mishaps. Every store has an obligation to clean too.
Wal-mart is hardly entirely innocent in this matter, regardless of who vomited (or why).

Nor would any other store.

Most parents don't have the means to clean the spill; indeed, most people don't have space to carry a bucket and mop. Though they could have contacted an employee to expedite the clean-up... but still, been in a walmart lately? They have more security cameras than a dirty dog has fleas. All things considered, they would have seen it quickly enough.

wearing. they'll want to see them when she gets to court.

i was standing in a grocery store, at the deli counter, and an employee who was pushing a flat cart stacked too high with produce crates went behind me and a couple crates crashed down on me. fucked me up for a year with emergency room shit, pain killers, physical therapy, and no insurance.

i got a lawyer. sued. they made a big fucking deal about the shoes i was wearing. as if i slipped and fell. which i didn't. i was standing still when this shit came crashing down on me.

but i had to bring in my shoes! what fucking idiots!

i won 12,000. the lawyer took 4,000 and the balance reimbursed me for all the medical bills--well, almost all of them. pain and suffering? HA! SUCK IT UP!
