What exactly does it mean when you say a Covert CIA Agent is "fair game"?

I would like to know what Rove meant by that statement, if there was no intent to harm. I am sure people have lost their lives or their freedom for much less than what Rove and Company did. Will there be no justice ever in this once great land of ours?
