Kokesh attorney seeks new hearing

The attorney for embattled reservist Adam Kokesh has asked the Marines for a new hearing.

In papers filed Tuesday with the Marine Mobilization Command, Michael Lebowitz said the three-member administrative board that heard the case was “improperly convened” because one of its members wasn’t a commissioned officer.

The board recommended Monday that Kokesh, a corporal in the Individual Ready Reserve, be given a general discharge for wearing a stripped-down uniform to a war protest and using an obscenity in an email to a superior officer.

But Lebowitz has asked for a new hearing because he said Chief Warrant Officer Steven Turner, a hearing board member, isn’t considered a commissioned officer under Marine regulations. He said Marine rules require all such board members to be commissioned officers.

1. If CPL Kokesh
had worn the same uniform and was waving the flag and carrying a pro bush sign we would not be going through this nonsense.

- CPL Kokesh told the truth and is tempting punishment.

- libby lies and the right wing hate machine cries crocodile tears when there is a wiff that a member of the party of responsibility and integrity may be held accountable.

The corporal's turds have more integrity then that of the entire membership of the gop combined.

for his hearing wore their uniforms all weekend. :)

The VFW issued a blistering statement on the controversy yesterday. Headline: "VFW to Corps: Don't Stifle Freedom of Speech."


The national commander of the proud, patriotic, 2.4 million strong Veterans of Foreign Wars (motto: "Honor the dead by helping the living") took one look at the mushrooming dispute between three antiwar Marine reservists and the U.S. Marine Corps, and knew where his sympathies lay: with the protesters.

"What the Marine Corps is trying to do is hush up and punish these individuals who served our country," Gary Kurpius, the national commander, said in a telephone interview. "All they're doing is exercising the same democratic voice we're trying to instill over in Iraq right now."

4. Good for the VFW
I am no fan of the organization but I agree with them on this issue and I hope they throw their weight around for the CPL.

7. And as soon as the VFW released that statement,
the Marines decided to emphasize Adam's vulgar language in a letter to them. It wasn't about the uniform anymore. Interesting timing.

The CPL was just replying to the profanity he received from the CORPS. Semper FI his ass.
