More HATCH ACT Violations Noted. The georgewbush.org mis-directed e-mails contain evidence.
In addition to voter caging, this adds one more illegal dimension to the mis-directed e-mails, Hatch Act violations.

I just read a web page with the "catch-all" georgewbush.com e-mails.

By the time they wake up to the rampant corruption in the Bush administration and the fact that it goes all the way to the top, it really will be too late to impeach the f***ers.

After three congressional investigations – the investigation into Jack Abramoff’s contacts with the White House, the examination of politicization of the General Services Administration, and the investigation of the firings of eight U.S. Attorneys – brought to light the White House’s extensive use of nongovernmental e-mail accounts to conduct official business, the Committee directed the RNC and the Bush Cheney ’04 campaign to preserve e-mails to or from accounts held by White House officials.

In order to ensure compliance with both the Presidential Records Act and the Hatch Act, the Committee asked the RNC to produce e-mails that related to the use of federal agencies and federal resources for partisan political purposes.

Following staff briefings with the White House and the RNC, the Committee has reason to believe that many e-mails related to official government business may have been deleted from the RNC’s servers. As a secondary measure to obtain these e-mails, the Committee asked federal agencies to preserve any e-mails they received from or sent to these political accounts.

3. USG: Sending a political e-mail on a work OR personal account is illegal while at work.
Here is another approach to the misdirected georgewbush, et.al. e-mails. If a political e-mail was sent by the government employee while at work, it does not matter which e-mail system was used. The time stamps in the mis-directed e-mails will indicate if the government employee was at work!

OSC recorded 299 complaints last year -- an all-time high for the independent investigative agency charged with enforcing the Hatch Act. The law bars federal employees from engaging in any political activity during work hours, which includes circulating petitions and campaigning.

Sending a political e-mail, either on a personal or work account, is barred under the law. ............

The e-mails can be viewed with full headers. That allows determining, from IP numbers,
if the sender was at their workplace while engaging in campaign political activity.

There's a fine line between actions that fall within a civil servant's right to express an opinion on a political candidate or issue, and those that could be found to violate a law prohibiting political activity while on duty or in a government office.

The agency charged with enforcing that law, called the Hatch Act, has shown that it won't hesitate in pursuing potential transgressions. This means that the careless click of a mouse or stroke of a key could put a federal employee distributing political messages from his or her government e-mail account out of a job.

The Hatch Act restricts the political activity of executive branch employees of the federal government, District of Columbia government and some state and local employees who work in connection with federally funded programs. ....

OSC has developed a number of booklets, posters and fact sheets that explain the application of the Hatch Act. Copies of the booklets and posters can be ordered from the Government Printing Office. The fact sheet may be downloaded or emailed directly from the OSC website. Additionally, OSC has created a PowerPoint presentation - "Political Activity and the Federal Employee" - which covers the rules and regulations of the Hatch Act.

Waxman's Committee voted to issue a subpoena to RNC Chairman Mike Duncan regarding the potential violations of the Presidential Records Act with RNC e-mail accounts. This is not the HUGE net.

The Committee also subpoenaed the RNC for documents related to possible violations of the Hatch Act by White House officials. Considering the info in the posts above, basically the parameters of what constitutes a violation of ther Hatch Act, this really is a HUGE net. Any campaign related activity whatsoever on USG company time is a violation! It does not matter which e-mail system was used, an rnc.com, and rnc.org, or a dot.gov, any activity for the campaign while on duty as a government employee would be illegal.

The implications of the subpoenas' scope has only just struck me. If any e-mail evidencing violation of the Hatch Act is the scope, it is HUUUUGE!

SIMPLE! I think we have, with this law, the REAL REASON why years of White House e-mails before and just after the 2004 election disappeared. EVERYONE in the White House was playing politics all the time on the job, instead of obeying the law. SIMPLE!
