4. Appeal is pending to Texas highest Criminal Court |

The trial judge threw out one of the charges against Delay and the Travis County DA appealed. The Court of Appeals rejected the appeal but the opinion had some language that suggested that the DA was right and that the charge should be reinstated. The Travis County DA then appealed to the Texas Court of Criminal Appeals (the highest court in Texas for Criminal appeals) which agreed to take the case (the court could have rejected the case and not heard the appeal). The case was argued a while back and we are waiting for an opinion. The Court could had ducked the case by not accpting the appeal and some court watchers thought that the court was inclined to reinstate the charge against Delay.
When the opinion in this appeal comes down, then Delay will go to trial on either all of the charges or the remaining charges.
