Genarlow Wilson, sentenced to 10 years in prison for receiving consensual oral sex in 2003 from a 15-year-old girl when he was 17, is facing what will likely be a months-long battle in the Georgia Supreme Court to have his conviction thrown out, his attorney said today.

"Normally an appeal takes months," B.J. Bernstein said. "Even at an expedited level it is still going to take a while."

Meanwhile, Bernstein is seeking to get Wilson released on bond from prison pending the appeal. Douglas County District Attorney David McDade, whose office prosecuted Wilson, has so far refused to consent to a bond, Berstein said.

Douglas County Superior Court Judge David T. Emerson will make a bond ruling based on several criteria, including Wilson's risk of fleeing and his ties to the community, Bernstein said.

"None of those should be issues," Bernstein said. "He was out on bond before. He has always attended court like he was supposed to. He has no prior record."

"I want him out," Bernstein added. "It's time. Enough already."


Yesterday I watched news(Cable/MSM) and listen to the various talk shows.. This didnt get a sniff of airtime last night. I found one show that spoke of this .....It was a sports talk show..But Paris Hilton found god after 5 days in jail.

Look the kid made some bad choices I totally understand that I get it 100%.Besides he has all ready served enough time on this incident ..Basically he is looking at 10 year sentence for getting to third base with a female when he was a kid his self..

What 20 seconds 30 at most... Did they have any doctors( to address his mental frame of mind)/lawyers( legal wise) to talk about what the next step is for him??? It was rather disgusting that the Rev Sharpton was out in LA... Grandstanding for the Paris Hilton case... But his ass was no where near the state of georgia????

You had mentioned that the MSM spoke on it this AM.. I asked you just how long was it is thats all.( Nothing more nothing less) I am pretty sure that Paris Hilton finding God had more airtime then this case did.. Thats all.
