The most telling detail from Team Libby's response in support of bond pending appeal is this one:

Robbins, Russell spins courtroom losses into U.S. Supreme Court wins.



Its lawyers have argued six cases before the U.S. Supreme Court, including two back-to-back one morning in December 2002. It has four wins and one split decision.



"They are basically a portable appellate department,"

One thing the addition of Robbins suggests, though, is these guys aren't going to roll over and let Libby be pardoned anytime soon. Robbins' job is to get this reversed, before Justice Roberts' court if need be.

1. That also sounds like they're expecting Judge Walton to order
Libby to prison immediately...WHILE...they're working on his appeal.

Doesn't it usually take quite a while to get the SCOTUS to HEAR a case....IF THEY DECIDE TO HEAR IT AT ALL?

3. Not if it is a partisan Republican issue
They will take on a case at the drop of a hat if it is for the Republican cause. Take Bush* vs Gore for example..

2. Does anybody know the Supreme Court Judge that would FIRST
handle the Libby case. All emergency orders (DP stays etc) is first handled by the SC Judge assigned to that district.

4. Yep.
The 6-13 Team Libby "Reply in Further Support of His Motion for Release Pending Appeal" is clearly of a higher quality than some of the other recent defense documents. It is important to keep in mind that this "hired gun" is not going to focus on issues relating to guilt versus innocence .... but rather, entirely on procedural concerns. I don't think that even Mr. Robbins will win on this one, however.
