Scooter Libby: No Bail-Libby To Jail In 4-6 Weeks

A federal judge today ordered I. Lewis "Scooter" Libby to report to prison to serve his sentence while his attorneys appeal his case.

A Federal District Court Judge ruled that former White House Adviser I. Lewis 'Scooter' Libby must report to prison in 30 to 45 days, according to a breaking news report from MSNBC. Libby was sentenced last week to 30 months in prison after March convictions for perjury, obstruction of justice, and making false statements in an investigation of the leak of the identity of covert CIA agent Valerie Plame Wilson. He had sought to delay serving his sentence while his case was on appeal. Libby may now file an emergency appeal to keep him out of prison while he makes his case against his conviction.

Judge Reggie Walton today ruled that Scooter Libby will not be free on bail pending appeals of his convictions. (although this decision can be appealed.)The major issue raised by the defense was the constitutionality of Patrick Fitzgerald's appointment. The issue is this:
If Fitzgerald was not supervised, he was should be confirmed by the Congress. Now, he was confirmed as USA for N. Illinois, and some have suggested that this is the real answer to the question. The other argument is that he could have been fired, and that this means he was supervised. However, Judge Walton said before the trial that this is a "difficult question", thus adding fuel to the fire, before he decided against the defense's argument.

Under this order, Libby will be going to jail in 4-6 weeks, though no dates have been given, assuming there are no further legal appeals, which Judge Walton said was possible.

Walton, it is reported, that there were no "close calls" that would possibly lead to a reversal or new trial.

WASHINGTON - A federal judge said Thursday he will not delay a 2 1/2-year prison sentence for I. Lewis "Scooter" Libby, a ruling that could send the former White House aide to prison within weeks.

U.S. District Judge Reggie B. Walton's decision will send Libby's attorneys rushing to an appeals court to block the sentence and could force President Bush to consider calls from Libby's supporters to pardon the former aide.

No date was set for Libby to report to prison but it's expected to be within six to eight weeks. That will be left up to the U.S. Bureau of Prisons, which will also select a facility.

13. To put his affairs in order.
You know like get money from cheney, kiss off judith miller, make arrangements for his family to go to disney land. All those important things. In New Bedford the INS swooped down and hauled women out of the shop (where they were being paid slave wages) and sent them to texas. No time to even call to secure their children's welfare. Gov Patrick had to send social workers to texas to help them make arraignments for their kids. Shop by the way had a very lucrative contract with the government. Deport Libby ask questions later.

They are advised to pack a bag when they show up in court. Why is Libby not treated like any other felon?

21. For the Appeals Court to grant a stay it would be like saying J. Walton abused his discretion...
I frankly think that the Appellate Court will not set aside the order of J. Walton requiring Libby to report to begin serving his sentence in the normal course.

Is it possible that this conviction could be overturned on appeal? Yes, for some evidentiary ruling during the trial that might not even be known to the public. Is it likely? I think not.

The federal judge who oversaw I. Lewis “Scooter” Libby’s CIA leak trial said Thursday that he received threatening letters and phone calls after sentencing the former White House aide to prison.

“I received a number of angry, harassing mean-spirited phone calls and letters,” U.S. District Judge Reggie B. Walton said. ”Some of those were wishing bad things on me and my family.”

Walton made the remarks as he opened a hearing into whether to delay Libby’s 2 1/2-year sentence. He said he was holding the letters in case something happened but said they would have no effect on Thursday’s decision.

argued in September.
