But SECTION 1 of Article 2 mentions the VP while outlining the powers of the executive. It also says the VP takes over if P becomes incapacitiated.
The only other place that the VP is mentioned is in the last section of Art. 2 talking about impeachment.
VP also mentioned in Art 1 to break ties. NOWHERE in the constitution does it say the VP is in office to break laws, though.

This is the reason that the VP sits up there with the Speaker of the House when the President gives the SOTU speech.
If there is one major flaw in our system, it is the office of the VP, and I believe that's why Cheney targeted that office to exploit this flaw in the US Constitution so that he could gain power.
It is the most prominent exception to the separation of powers doctrine.

he's really just the president of the senate, which entitles him to nothing beyond breaking ties.
which also means that from an executive standpoint, no one should listen to him. this is why one former veep said that the office "wasn't worth a bucket of warm spit".
at least, that's the quote the way the papers ran it. my guess is that is was editted ever so slightly :evilgrin:

doesn't he have to abide by rules of conduct, ethics etc of the Senate?
what's the process to censure or impeach or otherwise discipline a "fellow" member of the senate?
and guess what - executive privilege doesn't apply if he's not part of the executive branch... can we smell the supoena now?

and be part of the executive branch, but when it comes to obeying laws that apply to the executive branch, he's not part of the executive branch. Would anyone be surprised if that's what he eventually claims? At least, I'm sure his lawyers are capable of talking out of two sides of their mouths at the same time, don't you think? Actually, Cheney is claiming that whatever HE says the law is, that's what the law is. He's above all branches of government and is whatever he defines himself to be. Maybe he should be proclaimed a god?
