Does Cheney have to be out of office before he can be indicted?

Does Cheney have to be out of office before he can be indicted?
I've been trying to figure out if he has to be out of office (either when his term expires of by impeachment) before he could be investigated and indicted. Agnew resigned because he was the focus of an investigation by the DOJ for crimes he committed when he held office in Maryland. Of course, back then, we had a DOJ - but if it got cleaned up or a real U.S. Attorney like Fitzgerald wanted to go after Cheney now, could it be done?

3. Indicted, probably. Investigated? Of course he can be. Clinton was.
Previously, there hadn't been what you might call the goods on him (Libby did his part by obstructing justice). This "I'm not part of the executive branch" stuff is really fishy and might get looked at due to the stench if nothing else.

He is, it seems, not in any particular office that he can be out of. Indicted? He is exempt from mere laws.

... a couple of weeks before he resigned, "I will NOT resign if indicted. I will NOT resign."

Turns out he resigned anyway. But I believe he was on solid ground legally speaking on that issue.

8. actually, he resigned, then pled nolo contendre to avoid indictment
Frank Sinatra loaned him most of the over $200,000 he had to pay in restitution for the bribes he took

9. He can be indicted by impeachment only when in office.
He can be indicted for a crime in the criminal code (only if indicted on a criminal charge vs a political crime) as a citizen after his term.
