Although, doesn"t the chief Justice on the Supreme Court preside over the trial? Or is that just for the House part?

The Senate has the sole power to try impeachments. The Vice President is the President of the Senate. He presides. The Constitution provides for only one exception in cases of impeachment: "When the President of the United States is tried, the Chief Justice shall preside." That's because of the obvious conflict-of-interest of having the VP preside when the President is tried. But there's no similar provision for having someone else preside if the Vice President is impeached.

The letter of the constitution does not state that a judge shall preside over the impeachment trial of the Vice President, but the spirit of the constitution does. The problem is, Cheney supporters will use the letter to delay the trial, and even take the matter to the Supreme Court. Of course, the court will not rule before the end of the current administration. Knowing this, and fearing the loss of support of some moderate Republicans in the 2008 elections, the Democrats will not start impeachment proceedings. This may not be what some people like to hear, but this is the most likely outcome.

Then, as soon as Crashcart is moved up, Impeach him too!

Legalisms should not stand in the way of justice. Not if there is a route through the jungle.


I still think that if Cheney were impeached, that there would be so much of a hue and cry if he tried to assert himself as presider that He would step down. But that is just my hopeful guess.

It sure looks like Shrub rubberstamps anything Uncle Dick wants.

Besides, Global Thermonuclear War is bad for Biz. Hard to enjoy your golf game in an underground bunker. I think even Crashcart has his bosses. I think that is the real reason we haven't gone to war with Iran. Even though they don't have nukes yet, Us using nukes would lead to some very unpredictable, but uniformly bad, consequences. For Exxon and the other oil companies as well as everyone else.

Administration cares about very unpredictable, but uniformly bad, consequences.

I'd like to think that they do - but see no signs of it.

Oops.

The Chief Justice only presides if the VP is acting as President. I earlier posted that the CJ presided. But that's not necessarily true.

11. Get The Specific Criminal Charges And Lets Go
Impeachment isn't some magic wand that happens overnight. The door has opened to apparent criminal, or at least unconstitutional, actions by cheney that make a clear-cut case for drawing up articles of impeachment. Now the game goes to the House Judiciary Committee...John Conyers. The question here...as it was with Nixon in '74, is will there be a charge that pulls over at least one or two Repugnican committee votes...thus giving the articles a "bi-partisan" nature. Several Repugnicans DID cross over in '74...but I'm not sure we have such intrepid souls today. You still have "Tex" Sennsenbrenner there as well as Mary Bono. That's the sad thing...even with overwhelming evidence there are hacks who will put their party or agenda ahead of justice and the Constituion.

While I think the best case for impeachment at this point...and the one that would decapitate this regime the most...would be going after Gonzo. The book on him is as thick as a phone book and investigating him leads to both cheney and boooshie as well as rove and others...let's widen this net.

What really needs to be done now is to force crashcart's hand in court...push subpoenas and contempt of Congress citations that will force the tough questions to be answered in courts...just like Nixon's smoking gun tape was. When that happens, we cross into a new scenario.
