Could Bush pardon Cheney and his terror regime and then
resign (or step down for health reasons) so Cheney can then pardon him?

10. Seems others are wondering about massive
preemptive pardons...

DU thread:

Satirical Snow-job comment:

"Let me say right here and now: It is fully within the president's constitutional right to, uh, preemptively pardon all criminal Republicans who are all, of course, totally innocent and who have all been -- or, you know, will soon be -- wrongly accused by terrorist-loving liberals who hate our freedoms and have a very obvious gay agenda," he muttered, his eyes rolling around in his skull like marbles in Satan's pinball machine.

2. If they'd impeach Cheney, then he can't be pardoned, it's the only
Constitutional limit on Shrub's power to pardon

3. The asshole can do anything he wants. He's the decider, after all.
Without action by Congress to rein him in, there is nothing stopping him.

4. I don't follow, how could Bush pardon Cheney before..
he's been charged with anything? I assume that Cheney would have to be charged and convicted of something before he could be pardoned, in which case he wouldn't still be in office, so I don't think this scenario is valid.

5. Does a pardon have to follow from criminal charges?
Article II, Section 2 "The President ... shall have power to grant reprieves and pardons for offenses against the United States, except in cases of impeachment."

Does 'offenses' mean (in the specific legal sense) criminal charges?

8. Good point, but Articles of Impeachment were already..
being prepared as I recall.

Maybe that's the answer, maybe Congress SHOULDN'T impeach or bring charges of any kind against Bush or Cheney until after they leave office, which by then hopefully the Democrats will have the White House, and there will be no pardons, off to prison with the both of them!!!
