Poster at TPM.com makes convincing case that Bush may have committed a felony by directing Miers not to testify before Congress. Check this out:

Invoking a privilege is one thing, but telling a person not to show up in response to a subpoena -- if only to actually invoke the privilege -- is quite another. It's not just worse, it's a felony under federal criminal law. See for yourself.

18 U.S.C. Sec. 1505 : ... Whoever corruptly ... influences, obstructs, or impedes ... the due and proper exercise of the power of inquiry under which any inquiry or investigation is being had by either House, or any committee of either House or any joint committee of the Congress ... shall be fined under this title, imprisoned not more than 5 years ... or both.

18 U.S.C. Sec. 1515(b): As used in section 1505, the term "corruptly" means acting with an improper purpose, personally or by influencing another, including ... withholding, concealing ... information.

Sure sounds like an application of the law to the facts we know would lead to the conclusion that Bush may very well have committed a felony.

The challenge, not to be a naysayer here, is to prove the "corrupt" obstruction or impedance.

Someone has to step up and say "I heard Bush tell her to stonewall like hell and not tellum nuthin, because if she did, he'd be screeeeeewwwwwwwed!!!!!"

I can't stand these criminals, but the question is proving it. His wide-eyed claim is that he's protecting the "OFFICE" of the President. We know what he's really doing, but the challenge is finding someone who can say "He's lying, I know, I was there, I heard, I saw." Or the smoking email, that tells Harriet to "...pipe down so we'll stay outta jail!!"

They're sharp. They cover their tracks....but there's always some asshole who doesn't delete the email, that copies the notes and saves them, who forwards the note to some other pal because he's bragging....I'm hoping someone steps up.

2. Thanks for alerting me to the errant strikeout.... but here is an a possibility...
These clowns thought technology would save their behinds, but in the end the technology is gonna hang em all. For example today, Sara Taylor mouthed 'I don't recall being aware' as her hold card, and then she is confronted with an email that has her name on it.

I am betting that Miers' blackberry or email account will come back to bite them in the end.

3. I think your scenario is our best hope. With any luck, Miers or any one of
a few others who are technological Luddites like me will have screwed up and sent the wrong thing, the wrong way, to the wrong place!

One can only hope!
