Wiccan Warriors discussion of the Bill of Rights...4th Amendment
ok I would like to post one amendment to the Constitution in here a day and get everyones opinion on it, how they feel about it, how it has been upheld or stripped from us, just in general talk about it and if you ever had a time to use/exercise it.

Amendment IV

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.


OK this one is an outstanding amendment and quite possibly more important then the 2nd, to me anyway, so many times have I seen people give up their 4th amendment rights it is sickening. NO POLICE OFFICER has the right to search you, your house, or you, WITHOUT a warrant they will use scare tactics and say "Well sir/ma'am we can do this the easy way or the hard way if we have to go bother a judge and get a warrant will will come in and tear your house apart until we find what we are looking for.".

Unfortunately I have seen so many get scared at their tone and body movement they submit right away and say go ahead I have nothing to hide. Listen if you have anything to hide or not you are telling them that ok you threatened me and I know I'm not hiding anything, but ok I'll give up my 4th amendment right and let you go through my things. :freak: What is going on here.

At 10pm one evening I had an officer pull me over about 3 or 4 months ago, he was a local city police officer, upon pulling me over here's how it went:
Officer-May I see your license, registration, and proof of insurance please?

Me:---going through glove box for the info and grabbing my license and putting them in my hand** Sure thing Officer may I ask why you pulled me over sir?

Officer-Just give me your information sir.

Me-As you asked officer

Officer-Do you know why I pulled you over?

Me-No officer please explain.

Officer-Do you know how fast you were going?

Me-I could not honestly tell you sir, what did you tag me at?

Officer-Doing 55 in a 40 does that sound about right to you, were you going that fast?

Me-Again officer I'm not sure, but if you say you clocked me at that then who am I to dispute it it's your word against mine and we know how that goes right sir?

Officer-Where are you headed too?

Me-A friends house right now.

Officer-Where does he live

**Now my friend I was going to go see is a great guy and not into Drugs, but by Chance and affordable housing he has to live in a high drug area..***

Me:Sir to be honest once again I don't see how being pulled over for speeding has anything to do with where I'm going so I'm am going to decline to answer that sir.

Officer-Do you mind opening the Trunk?

**At this point I was smiling I knew if I told him where my friend lives and I was going to see him he would then be able to search my trunk without a warrant because then it would have been probable cause to search the car then after he found out nothing was there he would follow me and keep an eye out for me in the area my friend lives so he could pull me over for being in a known drug area... he would come up with something I know he would.***They do it all the time.

Me:Yes I do mind officer and not without a warrant I will not open it, sir when you pulled me over I shut off the car and turned on my dome-light so you could see I have nothing to hide and now for you to have me give up my 4th amendment right is disturbing.

Officer-Do I need to get one then?

Me-If you feel you have enough too go for it sir.

After 10 min of him and his partner talking he bid me a good night and drive safe....later I found out by exercising my right he got pissed off and raised the speed on the ticket 2 mph more so my ticked was $80 more so I guess I had to pay for using my rights.

2. There are myriad complications to search rules, but...
one unconfirmed story I heard should make you feel a little better.

Maybe 15 years ago in New Jersey racial profiling was still the norm but was getting some publicity. The cops at Newark Airport were a little late getting with that particular program, but when they did, they did it with zeal.

Black man with out of state plates on expensive car? That's the way the state cops made Turnpike busts, so why not at Terminal B? (No matter that the black man in question was in his 50s.)

"Open the trunk, please?"

"Do you have probable cause?"

So, after impounding his car and hauling hom off to their little jail, they noticed from his various IDs that he was a Federal judge.

4. Print this out, hand it over with your license
I prefer even before they ask for permission to search.

Sign ahead of time, date if there's time. Works as a card, with notice on front, 4th Amendment on back. I've successfully turned searches on 24 consecutive stops over 16 years.



NOTICE TO LAW ENFORCEMENT OFFICERS

I do not consent to a search of my person, belongings, home, or
vehicle. I retain my 4th Amendment Rights, and all other Rights
under the US and State Constitutions.

Date, time of notice (optional) ________________________

_______________________________________________________________________

The 4th Amendment
