Military uphold your oath & Congressional Oversight Preservation Act

When we look back at this time will we....

1. See it as a time when we could of stopped despots from dismantling 231 years of Democracy.

or

2. See it as a time when the great experiment overcame yet another challenge and the democracy that our founding fathers designed lives on.

I believe the constitutional crisis is real and that is our National Emergency, not terrorism. It is one of an internal dissolution of our system of governance by the systematic erosion of the checks and balances laid out in the constitution. The Republicans over the past 30 years have driven this nation further and further away from a nation of people bound by the rule of law. The Republicans have twisted it in the belief that a powerful executive presiding over a one party government that is driven by the morality of the corporation and bound by the social constructs of fundamental Christianity is the course for the future.

We are at a crossroad now. As the end of George W. Bush's second term looms it is clear that their intention is to move this nation into a new realm of existence. He will make this nation into a authoritarian dictatorial police state. The congressional majority will not have the power to stop it. The people will not be able to effect change in the polling places soon enough and the Republican solidarity is too great to remove Bush and Cheney from office via impeachment. As long as the President remains Commander in Chief of our armed forces and they remain loyal to the dismantling of our constitution in combination with the politicized Justice department nothing can change the prospect of an American police state.

All that is left is to implore our Military leaders to abandon support for this Presidency and hold to the oath that requires the defense of the Constitution of these United States and for Congress to act to strip away the self appointed powers the executives branch has afforded themselves.

The Military Oath

"I, {insert name here}, do solemnly swear, (or affirm), that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter. So help me God."

The joint chiefs of staff need to ensure that the transition of power remains intact on January 20th 2009. They need to do this by protecting our Nation from our domestic constitutional enemies. They are currently found in the White House.

This nation is only as strong as the belief and faith we hold in the constitution that binds it. Scholar after scholar has determined that the Neo-Conservative Republicans and George W. Bush have eroded the power of our constitution as they shaped our government to fit into a idealogical mold that is more suited to a authoritarian state rather than a democratic republic.

It is now time for our military to stand for freedom and the preservation of liberty and this great nation of free people. Stand firm, Hold fast and protect our constitution before it is too late. The American people deserve your allegiance.

Congress can illustrate this administration's intent to the Military leaders with a joint binding resolution that provides for congressional veto power of Executive Orders and Singing Statements.

The Congressional Oversight Preservation Act

The act calls for the President and Vice-President to uphold the constitution of the United States as written. They shall make no exceptions written or proclaimed that directly contradict the U.S. code of laws or the Constitution. Signing Statements and Executive Orders are subject to the bounds of law and the constitution and are subject to congressional oversight. If they are found in conflict with existing law and the constitution by the Judicial committees of the House and Senate they are then declared non-binding and rejected. This act supersedes any law that grants authority of the President under the executive declaration of a National Emergency, to interrupt elections or disband congressional authority. In the event of a catastrophic loss of 2/3s of congress the state's governors will act in congress's place until special elections and or legal appointments are made.

Placing this Act in front of republican law makers will be the crucible that determines exactly what they believe in. America as a nation or the ideology of neo-conservatism.
