I'm fairly certain you're referring to Presidential Directive 51. Here's a link. Please indicate where it "basically" nullifies Congress in case of a national emergency.

Since WWII, more or less, there's been a directive issued as to what happens if there's a nuclear attack that makes it impossible for Congress to meet or decimates (or more) the executive or judicial branch. They differ in details.

Now, there's an incredibly important detail, one that changes everything: * is the first one to make a substantial portion of the text public. *'s has a secret codicil to it; Clinton's is entirely secret, there was just a summary of part of it issued (SOP). It's easy to take new knowledge about something as indicating that that something is new. In this case, it's not.
