YORK — A judge may end up casting the deciding vote in the firehouse primary between Republicans Brenda Pogge and Sheila Noll.

Noll lost the nomination for the 96th House last month by just 23 votes. She has now filed suit in Williamsburg-James City County Circuit Court to have the results thrown out.

Noll charges that Pogge “knowingly” committed election “fraud.” Representing Noll is attorney Patrick Pettitt, ironically a past Democratic candidate for the 96th.

The 96th District Committee found that 35 voters who were ineligible under the rules of the election voted in the James City County polling place, actually held at Walsingham Academy in Williamsburg. The rules were followed in York County. According to the Noll campaign, two of those voters were Pogge’s husband, Roger, and her pastor, who served as a poll watcher for her campaign.
