8. They're going after 'vanilla' contempt first

I think they're trying to force a Constitutional confrontation on this issue so that they are "forced" to use the inherent contempt power. They'll let this kick up to the (5-4) SCOTUS, and then will be left with the inherent contempt option.

That's just my gut feeling, anyway.
