SOLICITOR GENERAL PAUL CLEMENT
He will decide on the Special Prosecutor. Who is he?

I'm not confident he'll agree to appoint a special prosecutor, however, I don't think the Senate is relying on this anyway. I believe they must be expecting him to reject the request, however, I'm not sure at that point what they would do. Perhaps they will have no recourse at that point except to try Gonzo themselves via impeachment.

Keep in mind, this is PROCESS. They HAVE to do this w/in the bounds of law. It's frustrating to us, but they are NOT lawless yahoos like the Republicans. They are putting they're ducks in a row and amassing a rock solid case and exhausting every avenue so they are left w/ no choice but to impeach Gonzo.

Solicitor General Paul D. Clement advised President Bush yesterday that there was no need for him to comply with subpoenas from the House and Senate seeking documents and testimony from current and former White House staff over the U.S. Attorney firings scandal.

“It is my considered legal judgment that you may assert executive privilege over the subpoenaed documents and testimony,” he advised.

But I'm sure Obstruction charges would be PART of the charges leveled against Gonzo during his inexorable (IMO) impeachment. That is where this is heading. They are cornering Gonzo and inexorably moving towards his impeachment, having exhausted all other appropriate measure first.
