N.M. Gays Can Marry in Massachusetts
Gay Couples From New Mexico Can Marry in
Massachusetts, State Official Says


By JAY LINDSAY Associated Press Writer
BOSTON Jul 26, 2007 (AP)

Gay couples from New Mexico can marry in Massachusetts
because their home state has not explicitly banned same-
sex marriage, Massachusetts officials say.

New Mexico joins Rhode Island as the only states whose
gay residents are allowed to marry in Massachusetts, the
only state that has legalized same-sex marriage. But
neither Rhode Island nor New Mexico has said it would
recognize the marriages after its residents return home.

Stanley Nyberg, Massachusetts' Registrar of Vital Records,
instructed city and town clerks in a July 18 notice to
give marriage licenses to gay couples from New Mexico.

Alexis Blizman, executive director of the pro-gay marriage
group Equality New Mexico, said she was pleased by the
decision, but predicted it would not lead to a rush to
Massachusetts.

1. The door is open
Once a New Mexico same-sex couple get legally married in Mass., they can DEMAND that their state recognize that marriage as legal and valid under New Mexico law, absolutely no different than a mixed-sex marriage done in Mass. If (when?) the state refuses, we finally have someone with undeniable standing to bring suit to the Supreme Court.

3. And if it turns out not to apply...
Perhaps I should float another initiative, one using the Supreme Court ruling to say that only Washington marriages are valid in Washington. :evilgrin:
