Suppose Gonzales resigns during Recess. No Senate confirmation is necessary

for a successor appointed then, and that successor can remain until the next Congress takes office after the general election.

Will the Congress have any recourse?

"I suspect there will come a time here, maybe as early as the August (congressional) recess when everybody's out of town, when the attorney general decides that his best course is to go." (Richard Galen, GOP consultant.)

Bush could then make a so-called "recess appointment' of a new attorney general. The Constitution gives him that authority. Such appointments, made when Congress is in recess, bypass the Senate confirmation process entirely.

Such an appointee could serve until the next Congress convenes - which coincides with the inauguration of a new president.

But as of now, the administration is standing fast behind Gonzales, and there is zero talk of a replacement.

4. Not how a recess appointment works.
It goes through the end of this Congress.

3. This should be their next move.
At least this would be the smart move politically.

Gonzo resigns, citing "...more time with my family" and so on.

Pundits go wild about how the Dem's finally got to him, etc...

Dem's puff their chests about checks and balances working...

Nothing changes.

Bush and Cheney slither back into the bunker to further ruin our lives.

Bet on it.

6. Didn't someone here say...
that Reid, etc. are going to force the senate to meet every X number
of days to avoid officially going into recess? I hope this is correct, because it is
the only way I see to prevent this scenario.

Anybody have a link?

13. Recess Appointments
I have suggested several times that the House and Senate remain in "plenary session"...preventing Booshie from "recess" appointing anyone...the way he snuck Bolton into the U.N. and just recently allowed the Slimeboater Fox to become Ambassador to Belgium despite being exposed as a fraud by John Kerry.

There is a procedure that would require a designated Congressman and Senator to stay in the beltway and do a quick daily open and close of the session. I'm not completely sure of the procedure, but there is a way to keep the session going during a break...and I strongly suggest Democrats start doing this because we know this regime will avoid any confirmations and try to endrun the Congress.

7. I came across this article on how Reid could try and prevent those recess appointments I am not sure
if this will be done but it shows how he could do it.

http://www.usnews.com/blogs/washington-whispers/2007/5/20/bushs-summer-hires-targeted.html

Senate Majority Leader Harry Reid has a little trick up his sleeve that could spell an end to President Bush's devilish recess appointments of controversial figures like former United Nations Ambassador John Bolton. We hear that over the long August vacation, when those types of summer hires are made, Reid will call the Senate into session just long enough to force the prez to send his nominees who need confirmation to the chamber. The talk is he will hold a quickie "pro forma" session every 10 days, tapping a local senator to run the hall. Senate workers and Republicans are miffed, but Reid is proving that he's the new sheriff in town.

11. That's a good idea.
It would keep Gonzo in the hot seat, although I have a hard time imagining who Blivet could appoint that would be worse. (Of course, I have had problems before, trying to imagine how low this maladministration could go.)
