Admitted Pedophile Sets Up Web Site
Admitted Pedophile Sets Up Web Site

Jack McClellan not only admits he is a pedophile, he has operated a Web site in Seattle and in Los Angeles posting pictures of children and rating the best places to watch little girls or LG's as he calls them.

One mother was horrified to read a description of her own child at a festival. "Immediately my skin began to crawl, and I thought this man is talking about my child. Who is this man? Why is it OK for him to speak about my child?"

Police have distributed a flyer warning parents to closely monitor their children if they see him. But since he is not a registered sex offender and hasn't broken any laws there is little more they can do.

"You can't arrest him for just advocating sex with underage children," said UCLA Law Professor Eugene Voloka. "He has a constitutional right to do that."

1. OK, since I'm not a lawyer...

Since sex with underage children is a crime, doesn't advocating it count as suborning? Like if it can be shown that a child molester read McClellan's site before doing the deed, shouldn't McClellan be considered an accomplice?

Edit: typo

2. I think the first amendment gives people the right to advocate violent crime...

...as long as it doesn't incite imminent lawless action. That's the phrase used by the SC in Brandenburg v. Ohio.

So McClellan's free to advocate rape just as I am free to advocate someone putting a slug in his twisted brain.

5. Should the Beatles be held responsible for the Manson murders?
Of course not.

This is the ugliest side of free speech.

Not QUITE yelling fire in a crowded theatre, but close.

6. It occurred to me after I posted

that my question was rendered absurd by Vladimir Nabokov. ;) Though it should be mentioned that on the White Album, the Beatles didn't advocate the commission of murder - though they may have advocated smoking weed, but even then only elliptically. Hell, even Nabokov only described a pedophile, and didn't advocate pedophilia.

4. You can't arrest him...
...but you can kick his ass. I expect that'll happen soon enough.
