If Roberts were to die or become incapacitated
and Bush tried to name Scalia Cheif Justice,I wonder would the Democrats rollover for it ?

11. bush can appoint anyone he wants for chief justice that is already on the court.He can't
appoint anyone new without the democrats voting for it. They have the majority. AND there is no cloture..it is up or down .

14. Not true. Even a nomination of a sitting Justice to be Chief Justice is subject to Senate consent.

One word: Rehnquist. (The Senate confirmed his appointment as Chief Justice by a 65-33 vote in 1986.)

18. yep. and fortas.
Fortas was a sitting associated justice when Earl Warren announced he was going to retire. LBJ decided to elevate Fortas to the CJ position, and confirmation hearings were held. Fortas' nomination was held up by a filibuster and he withdrew his name from consideration. Initially he continued to serve as an associate justice, but subsequent issues relating to alleged financial improprieties led to his resignation a year later.

Any candidate for Chief Justice has to be confirmed, whether he or she is already on the court or not.
