August 15, 2007 -- Accused of rape and facing up to 25 years behind bars, City Councilman Dennis Gallagher has hired legal big shot Benjamin Brafman, who has kept hip-hop mogul Sean "Diddy" Combs and nightclub king Peter Gatien out of jail.

"I can confirm that I have been retained to represent Councilman Gallagher," Brafman said yesterday.

Gallagher, 43, from Middle Village, Queens, tapped Brafman over the weekend. A 10-count indictment charges the second-term councilman with rape, criminal sex act and assault.
