Does it matter who Bush appoints or how he does it? Won't a fight over this derail the Dems more than they are now?

5. Interim appointment during a recess requires no Senate confirmation
I'm betting Bush will take a swipe at Dems in his announcement, blame everything on them, then conclude with something along the lines of, "Now maybe the Democrat led Congress can get to work with no more witches to hunt". (Or words to that effect)

6. Yes, and it would be a mistake to drag it out tooo long.
You have to remember, it is also very important to get the DOJ back to some form of decent functionality.

If you're lisstening to CNN & MSNBC, the top name mentioned (Chertoff) WOULDN'T be a slam dunk! Lots of baggage for him from Katrina!MSNBC guy said perhapse the best thing would be to pick someone from within the DOJ to put some feeling of stabilazion and confidence back in that Dept.

Whoever the replacement nominee is, the Senate should certainly question him intensely, but wether they chose the 1st nominee or fight for another, it's important to get the position filled and stabalize the DOJ.
