In these few minutes, what is the state of Kenneth Foster's case right now, scheduled to die tomorrow night?

LILIANA SEGURA: Basically, as you mentioned, the Board of Pardons and Paroles makes its recommendation today, I believe at 1:00 p.m., to Governor Rick Perry. And actually that recommendation was supposed to be made yesterday, but they postponed it, following a meeting with Kenneth’s father, his grandfather and his lawyer. So that’s very unusual, and we’re taking that to be a very good sign.

You know, almost all of the Texas papers have run editorials calling for clemency, basically, and saying this is sort of an outrage. And Rick Perry, I believe, is under, you know, quite a bit of public pressure. So even though the odds are against us when it comes to the board decision, because they’ve only ever recommended clemency twice, and Rick Perry has never granted clemency, in this case, you know, there’s quite a bit of public scrutiny. And also with these very high-profile people -- you know, Jimmy Carter, Desmond Tutu -- that’s hugely significant.

So we'll know by 1:00 p.m. the decision of the board. In Texas they’re going to have a press conference at 5:00.

"We remember the victims, but not with more killing," said event organizer Art Laffin, himself a murder victim family member. "Kenneth Foster is innocent of the murder of Michael LaHood. The state of Texas has admitted that Foster did not commit the murder. It is a simple matter of fact that Michael LaHood was killed by Maurecio Brown, who has already been executed. The murder of Michael LaHood occurred when Brown left the car that Foster was driving and got into an altercation with LaHood. Foster had no prior knowledge that Brown would carry out this killing, but under the state's "Law of Parties" he was convicted and sentenced to die. We cannot let this happen."

It's quick. It's easy. At the first number they didn't ask what state I was from. At the Gov's, I hung up after giving my name. But I guess there's no shame in not being from Texas, is there?

SAN ANTONIO -- A host of state lawmakers came to the defense of a man Wednesday who is scheduled to be executed on Thursday in Huntsville for a 1996 murder.

Rep. Ruth Jones McClendon and Rep. Mike Villareal disagree with the sentencing and sent a letter of clemency to Gov. Rick Perry signed by them and four other representatives to plead for Foster's life.

"We should take extra careful attention in deciding to murder somebody -- execute somebody -- who did not directly murder another person," Villareal said. "(He) may in fact have evidence to demonstrate that (he) acted against the crime."

47. Indy Media report from early this morning:


The state of Texas has postponed an 11th hour decision regarding the impending execution of Kenneth Foster Jr., also known as Haramia KiNassor, whose case has sparked a reckoning across the United States because he has never killed anyone. He is being executed because one of the passengers in the car he was driving committed a murder. The best friend of the victim, the confessed killer, Former Bexar County District Attorney, former US president Jimmy Carter, and South African archbishop Desmond Tutu have all stepped forward to decry the impending injustice.

The Board of Pardons and Parole was set to respond to the appeal on August 29, but they have put off their decision until Aug30. Subsequent to their announcement, Foster was moved to Huntsville Prison, where the executions take place. Foster's supporters are unsure how to interpret these events and ask that faxes and phone call continue. Local protests are planned at prisons in Huntsville and Livingston and at the governor's mansion in Austin.

Foster's execution is scheduled one day shy of a year after the execution of his close friend and comrade Hasan Shakur. Both Shakur and Foster became activists on death row, struggling to uplift the human dignity of those caught in a system that many liken to modern day lynching. Texas recently executed its 400th prisoner since resuming the practice of state-sponsored killing in 1982. Three other executions are scheduled for this week alone.
